The development of the legal concept of “judicial review.”
The intent of this entire class has been to get students thinking beyond the basic statutes of the law and to gain a better understanding of legal theory and philosophy – to go beyond the facts of a case and understand the reasoning behind the courts’ decision. The reason for this being that the facts change but understanding the legal theory behind a ruling will better allow you to apply that rule to your professional activities. With that in mind the final examination will require that you research and discuss the development of the legal concept of “judicial review.” This response should address the landmark Supreme Court case that established the right of the High Court to engage in judicial review and then address how judicial review has evolved over the last 216 years. This answer will be a minimum of 500 words and will reference the landmark Supreme Court decision as well as a minimum of three (3) to four (4) additional resources (court cases and/or legal journals, etc).
