International law and human rights
One month ago, a local non-governmental organisation (NGO) in Australia organised a demonstration ago to protest against laws being proposed by the government which would discriminate against Aboriginal peoples in the country. During the demonstration the police fired tear gas and arrested several hundred individuals. The procession was largely peaceful, and the NGO is claiming that the individuals arrested are principally Aboriginals and that they had not engaged in violence or other unlawful acts prior to their arrest. Those arrested are currently being detained without charge and have yet to be brought before a court. The NGO is claiming that even if the demonstrators’ cases come before the courts the judiciary are unlikely to be sympathetic to their defence as the judiciary are themselves ‘racist’. It therefore seeks your advice on submitting a communication to the UN Human Rights Committee. Draft the admissibility and merits of the communication, giving the NGO some indication of the strength and weaknesses of the arguments raised. The paper should be 2750 words long
