You are to write a critical essay on any recent development or change which is of significance to family law.
There have been a number of significant changes in the field of family law in the last 10 years or so. The list below is illustrative and therefore not exhaustive.
• Gender Reassignment Act 2004
• Marriage (Same Sex Couples) Act 2014
• The presumption of parental involvement under Children and Families Act 2014
• Re B 2013 [UKSC] 33, regarding the test to be applied in cases where a parent’s rights under the ECHR are concerned in Children Act 1989 cases.
• Reductions in legal aid (public funding) for certain family law cases
• The creation of the single family court
• Increased recognition of pre nuptial agreements by the courts
• The availability of arbitration cases involving family finances following divorce and separation
• Forced Marriage: Forced Marriage (Civil Protection) Act 2007 and Anti-Social, Crime and Policing Act 2014
• The principle of ‘sharing’ in financial remedy cases.
Your essay should consider the law prior to the change you are writing about; the effect of the change and should include opinion form academics, jurists and commentators. You should refrain from making personal observations.
