A girl “Mary” worked for a not for profit and was paid each week for 40 hours of work as a receptionist/ general office helper but that she actually worked about 45 to 47 hours a week. She said she read the Fair Labor Standards Act and saw that an employer is required to pay non-exempt employees time and a half (overtime) for hours worked in excess of 40 hours in a work week. Tell us if the employer of Mary could be liable for overtime pay and why? Then tell Mary what to do (give her advice) about this situation.
