UCC Filings and FTC case
First Part: Go onto the Ohio Secretary of State’s website and access its UCC fillings search page https://ucc.sos.state.oh.us/dashboard. . Under the “secured party” tab, search for a bank (e.g. Fifth Third, U.S. Bank, First Bank, Kemba Credit Union) in the Organization’s Name field, and put in a city and Ohio for the state. Hit search. A table of UCC filings will pop up. Pick one that has “Original” as the filing type. Hit the “view” button on the right. It’ll take you to another screen. Hit “download image” for the original document (i.e. the first one listed). It’ll download the filing. State the secured party (the bank), the debtor, when it was filed, and the nature of the collateral. Anything surprise you about the filing? Second Part: What do you think about this particular bank (or other creditor) having the ability to take ownership or sell of the collateral listed on the financing statement? Consider both the side of the bank and the side of the debtor. SECOND ASSIGNMENT: Go to the website for the Federal Trade Commission https://www.ftc.gov/news-events/press-releases? and find a FTC enforcement action that interests you. Make sure it is a case. It will have a defendant who did something that was anti-competitive or anti-consumer. State the name of the action/case and summarize it. What are your thoughts on the case? ( You cannot choose Triangle Media Corporation).
